W Hotel in Atlanta sued for wrongful death after window fall May 5, 2017

Over a month ago, a woman died after falling out of a window in the W Hotel in Atlanta. During her stay at the hotel, she and a friend crashed through the window on the tenth floor. After her death, the woman’s family filed a wrongful death claim against the W Hotel and other entities alleging that the window was not strong enough.

Two other individuals reported in an unrelated incident that the window in their room at that hotel fell out onto the ground. Because no one was hurt, the two simply paid for the broken window. But are the windows too thin?

Though the hotel administered a statement saying that the windows were properly installed and up to standards, several other incidents have occurred in other states that raise the question of safety. Several people were injured last month when glass panels fell onto the pool deck of a W Hotel. This happened on three separate occasions, prompting officials to close the hotel.

Investigators are still looking into the different incidents, maintaining that the circumstances in each incident are different. But especially for the family of the woman who was killed, the biggest question is whether the death could have been prevented.

Were the windows strong enough or were they too thin for their intended purpose? One would hope that windows several stories up would be able to withstand a person accidentally slamming into it. However until the investigation closes, this question will likely remain unanswered.

Even if the question is answered, the family of the woman who was killed will still be dealing with the loss of a loved one. No amount of money could bring her back. But a wrongful death lawsuit could not only provide compensation for their loss, it is also a way to hold the hotel and its owners responsible. Raising this type of awareness could help prevent similar accidents from occurring in the future.
